1. Scope
Last updated: .
Roadway Defense LLC ("Roadway Defense," "we," "us," or "our") is the developer and operator of the Roadway Defense CDL mobile app and roadwaydefense.com. This Privacy Policy covers our app, website, online forms, membership and service inquiries, ticket intake, attorney-network applications, and related email, phone, and SMS communications.
This policy describes our handling of information, including information we share with service providers. Independent attorneys, law firms, payment providers, and other third parties may also process information under their own privacy policies.
2. Information we collect
Depending on how you interact with us, we may collect:
- Identity and contact information: name, email address, mobile or other phone number, mailing address, state, and jurisdiction.
- CDL and service-request information: ticket or inspection details, dates, deadlines, license-related concerns, uploaded documents, and information you include in a message.
- Membership and account information: selected plan, enrollment status, service history, preferences, and communications about your account.
- Payment-method metadata: card brand, last four digits, and expiration date. We do not store full payment-card numbers or card security codes (CVV/CVC) in our app or on our servers.
- Invoice and payment history: invoices, amounts, dates, payment status, transaction references, and records of refunds or billing adjustments associated with your account.
- Attorney-application information: firm, bar number, licensed jurisdictions, experience, service areas, and application details.
- Communications and consent records: emails, calls, form submissions, SMS opt-in or opt-out status, the date and time of consent, and related support requests.
- Technical information: IP address, browser and device data, app or website interactions, timestamps, referral information, and security or diagnostic logs.
Please do not submit information that is not reasonably needed for your request.
3. How we use information
We may use personal information to:
- respond to inquiries and review ticket, inspection, license, membership, or network-application requests;
- provide requested services, coordinate next steps, schedule communications, and send account or service updates;
- manage memberships, billing, invoices, payment history, refunds, and payment-related support;
- authenticate account access and process documents that you choose to submit;
- maintain consent, preference, and communication records;
- operate, secure, troubleshoot, and improve our app, website, and services;
- detect fraud, abuse, security incidents, and prohibited activity;
- comply with law, enforce agreements, and protect the rights and safety of Roadway Defense, our users, and others; and
- perform other purposes disclosed when information is collected or with your permission.
4. Mobile information and SMS consent
SMS consent is optional. Website SMS opt-in checkboxes are unchecked by default, and you may submit a form without opting in to SMS. Consent is not a condition of purchase or service.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Message frequency varies. Message and data rates may apply. Reply STOP to any Roadway Defense message to opt out. Reply HELP for help. Additional program terms are available in our SMS Terms & Conditions.
6. Payment information and billing history
Payments are handled through third-party payment gateways, including their integrated SDKs. Roadway Defense receives limited payment-method metadata, such as the card brand, last four digits, and expiration date, to help identify your payment method and support account billing. Roadway Defense does not store full card numbers or CVV/CVC security codes in the app or on its servers. Payment gateways may process full payment details to complete a payment.
We use invoice and payment history to display and manage account charges, confirm payments, handle billing questions and refunds, reconcile transactions, and meet applicable accounting and legal obligations. Payment providers handle the information they receive under their own privacy and security terms.
Do not send full card numbers or security codes through our support forms, document uploads, email, or SMS.
7. Biometric authentication
If you enable biometric sign-in, the Roadway Defense CDL app uses your device's biometric authentication system, such as fingerprint or face authentication, to help you access your account. The device performs the biometric check and provides the app with an authentication result.
Roadway Defense does not collect, store, or transmit your biometric data, including fingerprint images, face scans, or biometric templates. That biometric data remains managed by your device's operating system. You can manage biometric authentication through your device settings.
8. Camera, photos, and document access
You may choose to use the camera, photo picker, or file picker to submit tickets, inspection reports, license-related documents, or other materials for your service request. Camera access is used to capture a document photo; the photo and file pickers let you select the materials you want to attach. Device permission is requested where required.
When you submit an attachment, the selected image or file and associated file information are transmitted to us and processed for your request, document review, account records, and customer support. Submitted documents may contain personal or sensitive information. They may be shared with the service providers or professional-service participants described in Section 5 when necessary for your request.
You can decline or revoke camera or other device permissions in your device settings. This may prevent you from using the related upload feature, but changing a permission does not delete documents you already submitted. To request deletion, follow Section 11.
9. Court dates and your calendar
When you choose to add a court date, Roadway Defense CDL opens your device's calendar so you can review and save the event. Event details, such as the title, date, time, and location where available, are passed to the calendar for that purpose. This feature does not read your existing calendar events or directly access your calendar database.
Adding the event is optional. Events you save are managed by your calendar app and may be synchronized according to your calendar provider's privacy policy and account settings. You can edit or delete a saved event in that calendar. Deleting your Roadway Defense account does not automatically remove events you saved in another app.
10. Data retention and security
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this policy, maintain service and consent records, resolve disputes, enforce agreements, and satisfy legal obligations. Retention periods vary based on the type of information and the reason it was collected.
- Account and membership records: retained as needed to maintain your account, deliver services, and address account-related questions or disputes.
- Uploaded documents and service records: retained as needed to review and support your request and address related legal or dispute-resolution obligations.
- Payment metadata, invoices, and payment history: retained as needed for billing, refunds, accounting, tax, fraud prevention, and applicable recordkeeping requirements. Some transaction records may need to remain after account deletion.
- Communications, consent, and security records: retained as needed to manage your preferences, document consent or opt-outs, respond to support requests, and investigate abuse or security incidents.
Retention decisions take account of the sensitivity of the information, the status of your account or request, applicable legal requirements, and whether the purpose can be met without identifiable information. When information is no longer needed for these purposes, it is deleted or de-identified. Backup copies may remain until they are replaced or deleted through the applicable backup cycle.
We use reasonable administrative, technical, and organizational safeguards designed to protect information. No app, website, transmission, or storage system can be guaranteed completely secure.
11. Account and data deletion
You can request deletion of your Roadway Defense CDL account and associated personal information, or request deletion of particular information, without installing or signing in to the app.
Email info@roadwaydefense.com with the subject "Roadway Defense CDL account and data deletion request." Use the email address associated with your account where possible, and tell us whether you are requesting deletion of the account and its data or specific documents or information. Do not send passwords, full card numbers, or unnecessary identity documents.
We may need to verify your identity before acting on a request. Once verified, we review the request and delete the account and associated information within its scope, except information that must be retained for applicable legal, accounting, fraud-prevention, security, or dispute-resolution purposes. We will explain any applicable retention exception when responding to your request. Retained information remains subject to this policy and is kept only for the relevant purpose.
Backup copies may not be removed immediately and remain subject to the retention practices in Section 10. Uninstalling the app, disabling a permission, or opting out of SMS does not by itself delete your account or information. Independent attorneys and other providers may retain their own records under their policies and legal obligations.
12. Your choices
- SMS: reply STOP to opt out at any time. Reply START to opt back in after an opt-out. Reply HELP for support.
- Email: use any unsubscribe instruction in an optional marketing email or contact us directly.
- Access, correction, or deletion: contact us to ask about access or correction, or use the account and data deletion instructions, subject to identity verification and applicable law.
- Device permissions: manage app permissions and biometric authentication through your device settings. Some features depend on the permissions you allow.
- Browser controls: adjust browser settings to limit cookies or similar technologies, understanding that some website features may be affected.
- Website privacy preferences: use Privacy Preferences in the footer to allow or reject Google Analytics, Meta Pixel marketing, Respond.io support chat, and Trustpilot reviews separately. Optional services load only after you allow them. Your choice is stored in this browser for 180 days. Turning off an active service reloads the page; these preferences are separate from SMS consent.
- Trustpilot: when you enable Reviews in Privacy Preferences, your browser connects to Trustpilot to display its Review Collector widget. Trustpilot receives technical request information, such as your IP address and browser information. Our website forms do not send your submissions to Trustpilot. You can use the ordinary Trustpilot profile link without enabling the embedded widget. Reviews you choose to submit on Trustpilot are handled under Trustpilot's Privacy Policy.
- Form security: Google reCAPTCHA is used on our forms to help prevent spam and automated abuse. It may process browser and device information and use a security cookie. Google's Privacy Policy and Terms of Service apply. This security check is separate from optional analytics and marketing preferences.
13. Children's privacy
Our services are intended for adults and commercial-driving professionals. We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, please contact us so we can review and address it.
14. Changes to this policy
We may update this policy from time to time. We will post the updated policy on this page and revise the last-updated date. Material changes may also be communicated through the app, website, or another appropriate channel.
